Terms of Service | Kogashitsuka AI

These Terms of Service govern your use of Kogashitsuka AI, an AI image enhancement service operated by Peak Studio LLC, a Wyoming limited liability company (Wyoming Filing ID 2026-001873199). By using the service, you agree to these terms.

1. The service

Kogashitsuka AI uses AI super-resolution to enhance images at their original dimensions or enlarge them by 2x or 4x. Supported formats, input and output limits, available scales, point costs and result retention periods are shown before processing.

The service does not promise to recover information missing from the source image. It is not specialist deblurring, camera-shake correction, focus restoration, face restoration or archival photo restoration.

2. Accounts

You must provide accurate account information and keep your credentials secure. You may not transfer, lend or allow another person to use your account. Contact us promptly if you suspect unauthorized access.

We may revoke benefits, adjust points, restrict use or suspend accounts where we reasonably believe multiple accounts or other methods are being used to evade limits or obtain benefits unfairly.

3. Free points and daily check-in

• A first sign-in bonus of 3 free points is generally granted once per account.
• Daily check-in may grant up to 2 free points once per Japan Standard Time calendar day.
• Free points are capped at 10, including points temporarily reserved for processing. No points are granted when the cap is reached, and another grant cannot be claimed that day.
• Any expiry date is shown when points are granted or in point history. Expired points cannot be used.
• We may correct or revoke points granted through an error, duplication, abuse or breach of these terms.

We may change or end free-point programs after notice, except where applicable law requires otherwise.

4. Point use and return

The point cost shown before processing applies to each image. Required points are reserved when processing begins and permanently consumed only after successful processing.

Reserved points are returned when processing fails because of our service or an external processor and consumption has not been finalized. Points are generally not returned for subjective dissatisfaction after successful processing, limitations caused by the source image, or problems with your connection or device.

5. Paid services

For point packs or other paid services, the checkout and final confirmation screen show the price, points, validity period, payment timing, renewal terms if any, cancellation method and refund conditions. Specific purchase terms take priority where they differ from these terms.

Because points are digital services made available after purchase, change-of-mind refunds may not be available except where required by law or stated purchase terms. See the Refund Policy and Business Information.

6. Image and intellectual-property rights

You may submit only images you own or are authorized to process. Copyright, publicity, trademark, privacy and other rights in the source image do not transfer or change through use of the service.

You grant Peak Studio LLC and its image-processing providers a limited permission to copy, transmit, store and transform an image only as needed to process it and deliver the result. See the Privacy Policy for image handling.

Commercial use of a result depends on the source-image rights, third-party license terms and applicable law. You are responsible for obtaining the necessary permissions.

7. Prohibited conduct

You must not:

• Break applicable law or infringe another person's copyright, publicity, privacy, reputation or other rights.
• Submit or create illegal or harmful material, including child sexual exploitation material, non-consensual intimate imagery, threats, discrimination or content promoting violence.
• Use results for impersonation, fraud, fabricated evidence or materially misleading purposes.
• Upload malware, attack payloads or data intended to disrupt the service.
• Evade authentication, access controls, rate limits, point limits or payment.
• Place excessive automated load on the service, reverse engineer protected systems or otherwise interfere with operations.

8. AI limitations

Results depend on the source image and AI inference. Details, text, faces, colors or edges may be inaccurate, and the system may generate details that were not present. We do not guarantee accuracy, completeness, fitness for a particular purpose or non-infringement.

Always compare results with the source and obtain professional review before using them for medical, legal, identity, journalistic, investigative or other consequential decisions.

9. Changes, interruption and termination

We may change, interrupt or end all or part of the service for maintenance, outages, security, changes to external services, disasters or other reasonable operational needs. We will give advance notice where practical.

10. Restrictions and account closure

We may delete images, adjust points, restrict use, suspend or close an account where you breach these terms, payment is overdue, abuse is suspected or action is needed to operate the service safely. We will provide a reasonable explanation when circumstances permit.

You may request account deletion through available account settings or the contact page. Some records may be retained as described in the Privacy Policy.

11. Disclaimers and liability

We provide the service with reasonable care but do not guarantee uninterrupted availability, error-free operation, absence of vulnerabilities, preservation of data or results that meet every expectation.

Our liability is limited only to the extent permitted by applicable law. Nothing in these terms excludes liability that cannot legally be excluded, including liability for intentional misconduct or gross negligence where the law prohibits such exclusion.

12. Changes to these terms

We may update these terms where reasonably necessary for changes to the service or law. We will publish the changes and effective date through the service or another appropriate channel.

13. Governing law and disputes

These terms are governed by the laws of Japan. The parties will first attempt to resolve disputes in good faith. To the extent permitted by law, the Tokyo District Court has exclusive jurisdiction as the court of first instance. Mandatory consumer protections in your place of residence remain unaffected.
